Entry into the national phase in Japan Within 30 months from the first priority date.

If a national entry has been requested without translation between 28-30 months from the first priority date, the translation can be filed within 2 months from the submission of the national application request.
Amendment to Specification / Drawings
  • Any time before a first Office Action is issued
  • Within a period of 3 months for responding to an Office Action (extendable by 3 months on request)
  • Within 3 months (4 months for foreign Applicant) from filing an Appeal Trial against the Final Rejection by an Examiner (no extension)
Filing an application claiming a priority Within 1 year from the filing date of the first priority application
Filing a Certified copy of the priority document

Within 16 months from the filing date of the first priority application.

PCT national phase application: within 2 months from the entry if applicant failed to submit it during the PCT international phase(R38-14-1)

Request for Examination

  • Applications filed on or after October 1, 2001
  • Within 3 years from the filling
Payment of the registration fees Within 30 days from the Decision to Grant a Patent (extendable by 30 days on request)
Filing an Appeal Trial against Examiner’s Rejection Within 3 months (4 months for foreign Applicant)  from the Notice of Examiner's Rejection (no extension)
Formality Amendment responding to an Amendment Order on appealing to the Appeal Board

Within 30 days from the Amendment Order

(extendable by petition)
Filing a Statement of Arguments responding to a Notice of Reasons for Rejection Within 3 months from the Notice of Reasons for Rejection (extendable by 3 months on request)
Refund of the Examination Fee Within 6 months from the submission of written withdrawal or abandonment of the application.
