Period for filing an Appeal has been Extended
The revised Japanese patent law that came into effect on April 1, 2009 extended the period for filing an Appeal. Before the revision, the period for filing an Appeal against Final Rejection was 30 days for domestic applicants and 90 days for foreign applicants. Now, it is three months for domestic applicants and four months for foreign applicants.
It should be noted that although it was possible before the revision to file amendments within 30 days following the filing date of the Appeal, the amendments must now be filed at the same time as the Appeal.
This revision applies to all applications that receive a first Final Rejection on and after April 1, 2009.
