Patent Prosecution Highway (PPH) Program between Japan and Russia

On May 18, 2009, the JPO and the Federal Service for Intellectual Property, Patents & Trademarks of Russia (ROSPATENT) started a PPH pilot program. Russia is the seventh country with which Japan has implemented the PPH pilot program, after the U.S., the U.K., Korea, Germany, Denmark, and Finland. Applicants with a granted Russian patent claiming priority to the Russian application may now request an accelerated examination of the Japanese application by an easy and simple procedure. As in the PPH program with other countries, applicants are required to submit the Japanese or the English translation of all the allowed claims and all the Office Actions.

The application which was examined by the Eurasian Patent Organization (EAPO) and granted a patent in Russia as a designated country will not be eligible for the PPH program. It should also be noted that claims that only received a positive opinion in an International Search Report (ISR) from the Examiner at the ROSPATENT which is the International Searching Authority (ISA) are not considered to have been determined to be patentable.
